Payments & Taxes
* All payments must be made in EUR.
* A 20% VAT is applied only to orders within Türkiye.
* Personal or business checks are not accepted.
* Payment is accepted only via bank wire transfer.

Force Majeure
FLYWITHSIM shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, supply chain disruptions, governmental actions, or transportation interruptions. In the event that a force majeure condition continues for an extended period, the parties reserve the right to terminate or adapt the agreement in accordance with applicable law.
Product Delivery Policy
International Orders
FLYWITHSIM is not responsible for any customs fees, duties, value-added taxes (VAT), or other additional costs incurred during the importation of its products.
Estimated transit times for international shipments are based solely on carrier estimates and do not include delays caused by customs clearance procedures.
FLYWITHSIM has no ability to estimate these fees or delays in advance.
Shipping Rules
For international door-to-door shipments, FLYWITHSIM provides shipment details via email.
If the customer requests an alternative carrier other than the one used by FLYWITHSIM, such request must be submitted to FLYWITHSIM via an official email signed by an authorized representative of the customer.
Acceptance & Commissioning
Products shall be deemed accepted within seven (7) business days from delivery unless the customer provides written notice of non-conformity. This acceptance period shall not prejudice the customer’s statutory rights regarding hidden defects, which shall run from the date such defects are discovered. Installation, commissioning, or operational use of the product constitutes acceptance.
Warranty
Limited Lifetime Warranty for the “Original Owner”
FLYWITHSIM warrants to the original owner that its products are free from defects in materials and workmanship.
At its sole discretion and in accordance with its internal procedures, FLYWITHSIM will repair or replace any defective part. Replacement parts may be new or refurbished products that are functionally equivalent to new.

* Digital control interface
* Computer and LCD displays (1 year parts – 90 days labor)
After 90 days, all warranty-related services are subject to hourly service fees based on the price list determined by FLYWITHSIM.
Onsite Service
For the first 90 days, onsite service is provided free of charge for parts and labor, subject to prior scheduling and availability in FLYWITHSIM’s service calendar.
All travel expenses, including hotel, airfare, and car rental, must be prepaid by the customer.
After the 90-day warranty period, travel expenses plus applicable parts and labor charges (including warranty-covered items) will be applied.
Exclusions from Warranty Coverage
* Accidents occurring during transportation
* Incorrect use or operation beyond system capacity
* Neglect
* Unauthorized interventions performed by non-authorized personnel
* Improper installation or servicing
All out-of-warranty service and repairs are performed according to a quotation provided by FLYWITHSIM.
FLYWITHSIM shall not be responsible for loss of revenue or business interruption resulting from system downtime, except in cases of willful misconduct or gross negligence.
Important Notice
Any unauthorized modification or alteration made to FLYWITHSIM products will void the warranty.
Following any customer intervention, FLYWITHSIM reserves the right to determine the scope and pricing of all work required to restore the product to operational condition.
Software & Firmware Licensing
All software, firmware, and embedded systems provided with FLYWITHSIM products are licensed, not sold. All intellectual property rights remain the property of FLYWITHSIM or its licensors. Reverse engineering, copying, modification, or unauthorized distribution is strictly prohibited.
Training & Certification Disclaimer
FLYWITHSIM products are intended for training, familiarization, and procedural practice purposes only, unless explicitly stated otherwise in writing. Use of FLYWITHSIM products does not guarantee any certification, licensing, or regulatory approval outcome.
Data & Telemetry Disclaimer
Any physiological, biometric, performance, or telemetry data collected by FLYWITHSIM systems is provided solely for training, analysis, and research purposes. Unless otherwise agreed in writing, FLYWITHSIM assumes no responsibility for decisions made based on such data. Data protection and privacy matters are governed by applicable data protection laws and separate privacy notices.
Export Control & Compliance
The customer agrees to comply with all applicable export control laws and regulations. Products may not be exported, re-exported, or transferred to restricted countries or entities without obtaining the required governmental authorizations.
Limitation of Liability
Except in cases of willful misconduct or gross negligence, FLYWITHSIM’s total liability, whether arising in contract, tort, or otherwise, shall in no event exceed the total amount paid by the customer for the product giving rise to the claim. Under no circumstances shall FLYWITHSIM be liable for any indirect, incidental, special, or consequential damages, including loss of profit or business interruption.
Damaged Shipment
Please inspect all packages upon delivery. Any damaged or missing items must be reported to FLYWITHSIM within three (3) business days of receipt.
If damage to the packaging is noticed at the time of delivery, report it immediately to the carrier and then contact FLYWITHSIM.
All products leave our facility securely packaged, tested, and in good condition. If damage is discovered after unpacking:
* Leave the box and contents as received
* Retain all packaging materials
* Take photographs of the damaged items
* Contact FLYWITHSIM immediately
FLYWITHSIM is not responsible for unattended shipments or packages left without supervision.

* Detailed description of the issue and troubleshooting steps already taken
Remote support via AnyDesk® is available under the same conditions as onsite service.
Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of İstanbul, Türkiye
